1. About these terms
These Terms and Conditions apply to your use of this website and to enquiries you make through it. By using the site you agree to them. If you do not agree, please do not use the site. Our paid services are governed by a separate written proposal or agreement, which takes priority over these terms if they conflict.
2. Our services
ErrorSol provides web design, development, e-commerce, custom software, UI/UX design, SEO and digital marketing services. Descriptions on this website are general information and may change. A quote, estimate or audit is not a binding offer until we both agree the scope, price and timeline in writing.
3. Quotes, payments and timelines
- Quotes are valid for the period stated on them, usually 30 days.
- Projects typically start once the agreed deposit is received. Payment milestones and due dates are set out in your proposal.
- Delivery dates depend on you providing content, feedback and approvals on time. Delays on your side may move the schedule.
- Late invoices may pause work until they are paid.
4. Your responsibilities
You agree to give us accurate information, to make sure you own or have permission to use any content, images, logos and data you supply, and to keep your own account passwords and access credentials secure.
5. Intellectual property
Once a project is paid for in full, you own the final deliverables created specifically for you, such as your custom designs and written content. Third-party items, such as fonts, stock images, plugins, themes and open-source code, stay under their own licences. We keep ownership of our pre-existing tools, code libraries and methods, and of this website’s design and content. We may show completed work in our portfolio unless we have agreed otherwise in writing.
6. Website content and acceptable use
You must not misuse this site. This includes trying to gain unauthorised access, copying or scraping the site’s design or code, introducing malicious code, or using it to send spam or unlawful material. We may block access if we reasonably believe these terms are being broken.
7. Third-party services and links
Projects often rely on third-party platforms, hosting, plugins and tools. They have their own terms, pricing and availability, which we do not control. Links to other sites are provided for convenience and are not an endorsement.
8. Results and warranties
We take care and apply professional skill in our work. Marketing and SEO outcomes, such as rankings, traffic and sales, depend on many factors outside our control, so we cannot guarantee specific results. Examples and figures shown on this website describe past work and are not a promise of future performance.
To the fullest extent the law allows, this website is provided “as is” and “as available,” and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some states do not allow certain disclaimers, so parts of this section may not apply to you.
9. Limitation of liability
To the fullest extent the law allows, ErrorSol, its owners and team members are not liable for indirect, incidental, special, consequential or punitive damages, including lost profit, revenue, data or business opportunity, arising from the use of this website or our services. Our total liability for any claim is limited to the amount you paid us for the specific service that gave rise to the claim in the three months before the claim arose.
10. Confidentiality
Each party will keep the other’s non-public business information confidential and use it only for the project, unless disclosure is required by law.
11. Cancellation
Either party may end a project in writing. You will pay for work completed and costs committed up to the date of cancellation. Deposits are non-refundable once work has begun, unless your proposal says otherwise.
12. Governing law
These terms are governed by the laws of the United States and of the state in which ErrorSol is registered, without regard to conflict-of-law rules. If a dispute arises, we will first try to resolve it informally and in good faith. If that does not work, it will be decided in the state or federal courts located in that state, and each party consents to their jurisdiction.
13. Changes and contact
We may update these terms from time to time; the date above shows the latest version. Questions? Email info@errorsol.com or use the Contact page. Please also read our Privacy Policy.
